Court of Appeal Decision on the appeal of the High Court's Judgement No 2 in the Re Edwards (Te Whakatohea) - this is deemed to be the second landmark decision in the MACA process.
The Court of Appeal review of the Decision from the first (Stage 1) hearing of Re-Edwards (Te Whakatohea) is the second "landmark" case in the MACA process and is now the subject of further appeal to the Supreme Court.
Stage 2 of the Re Edwards (Te Whakatohea) application will determine which party will hold any awarded CMT/PCR, and also if any wahi tapu recognition orders will be granted to CMT holders. There have been two judgements so far in the Stage 2 process : No. 7 (13 Oct 2022) and No. 8 (24 Apr 2023) These are attached below
